Repeal the European Communities Act 1972 to quit the EU straight away

European Communities Act 1972Britain’s wonderful historic vote to quit the EU will introduce much needed democratic accountability to the whole of Europe.

It is unnecessary to spend two years slowly extricating ourselves from the EU by invoking Article 50 of the Lisbon Treaty, during which time Britain would be obliged to continue paying billions into EU coffers and suffer continued mass immigration. With such lengthy advance notice of the closing of our borders there would be a rush of immigrants seeking to beat the cut-off date.

Instead we can repeal the European Communities Act 1972, the Act which took us into the clutches of the European block and bound us to all future Treaty changes. At a stroke we would be free. If German and French governments want to deliberately punish us for daring to leave the EU, by making our departure as expensive and troublesome as possible, then we have the option to avoid such abuse.

UK courts presently grant EU law primacy over domestic UK legislation, meaning that all UK statutes shall not apply where they conflict with European law. This is a departure from the British constitutional doctrine of parliamentary sovereignty.

As a matter of UK constitutional law, the present primacy of EU law derives solely from the European Communities Act. If the Act were repealed then any EU law (unless it had been transposed into British legislation) would become unenforceable in the United Kingdom and any powers delegated by the Act to EU institutions would return to the British Parliament.

Unfortunately, there is a potential large fly in the ointment: the result of the EU referendum is apparently only advisory, with no legal standing and not binding on MPs who could therefore claim to have autonomy and choose to remain in the EU irrespective of what the public have voted for. They could ignore the voters’ express wishes and do nothing to set in motion the leave procedures and even demand that another referendum take place after securing some additional minor concessions from officials. The EU has a sordid, undemocratic history of overturning referendums and demanding that voting takes place again, as happened in France, Denmark and Northern Ireland.

Sore losers among the Remain camp, particularly in Scotland, London and Northern Ireland, are calling for a second referendum on the grounds that their local area did not produce a majority vote for Brexit. A petition of several million names is calling for a rerun of the referendum, supported by the likes of David Lammy MP, Tristan Hunt MP, Michael Heseltine and Lord Astor, the stepfather of Cameron’s wife.

The biggest sticking point concerning negotiations with Brussels is their demand that Britain must agree to free movement of people in order to trade freely with the European Single Market, IE. continued mass immigration. As a result of large scale immigration England now has the distinction of being the most densely populated country in Europe, accommodating at least 8.3 million people born outside the country plus a similar number of their equally ethnic minority children who have been born here.

Free trade of goods and services has nothing to do with free movement of people and the former should not be made conditional on the latter!

      • Johnshaw in your eagerness for certain events/policies you do get ahead of yourself many times. Much as we would all wish otherwise, we WON’T be leaving the EU anytime soon. The British government has to trigger a notification of our intent to leave under Article 50 of the Lisbon Treaty (the treaty Gordon Brown didn’t dare let us plebs have a referendum about) and then there will be a TWO-YEAR period of negociation with our EU ‘partners’ which can be EXTENDED should a majority of the EU parliament wish for this to happen. If the two years period elapses and isn’t extended then we have to leave whatever the deal is and I have no doubt the other countries will seek to make it as tough as possible as they fear their own electorates wanting to escape from the EU.

        We may, therefore, NOT be leaving the EU at all should the majority in parliament find the ‘deal’ offered too bad to accept!

        The best way of leaving is to revoke the European Communities Act 1972 passed by Ted Heath’s treasonous Tory government without so much as a by your leave (ie no pre-legislative referendum which should have happened)

        However, this is not going to happen because we don’t have a true anti-EU party in the majority in the House of Commons. If only Britain were a REAL democracy with proportional representation as the voting system then people’s real opinions could be reflected properly in the House of Commons then we may not have got ourselves into the mess of EU membership in the first place and it would be easier to extricate ourselves now! Hopefully, this mess will awaken a few more people (ie those rather dim Tories reading their Tory rags like the Daily Express, Daily Mail, the Sun etc) into realising Britain really doesn’t do this democracy lark like johnny foreigner on the Continent! How ironic!

        • Whilst I agree doing the article 50 thing might be correct. I believe it is not. That article is a European get the best for Europe deal.
          Treaties are bits of paper, just as are toilet rolls /Signed by British Turncoat traitors. According to our Bill of Rights.
          So in fact not even legal.
          Thus you are in fact siding with the riff raff that sold our heritage just by agreeing that article 50 of the Lisbon Treaty has any validation . I’m sure you do not wish that. But stating WE must abide by that treaty is in fact taking sides.

          • I am a nationalist though a more modern, pragmatic and realistic one than you are! Most people did think the remain camp would win and they still might because until that article 50 notification is acted upon we will remain a full EU member and it could take TWO years OR EVEN MORE to get out. Indeed should the other EU countries decide to make an example of us and seek to make our exit as damaging as they can then the BRITISH PARLIAMENT could decide the economic cost would be so great they could not vote for it. The longer this stalemate goes on the more likelihood there is for the referendum result to be quietly forgotten.

( Party Official ) You can see from the above excellent article that the Brit Dems are ‘ on the ball ‘ with a solution to this situation , but we are being mislead by our Politicians here and the Superstate people in Brussels. For instance did you know that FREEDOM OF MOVEMENT is NOT ACTUALLY REQUIRED for access to the E.U. Superstates market ? Exports TO THE E.U. from 35 Countries , without freedom of movement amounted to nearly one and a half Billion Pounds worth , last year ! These People are LYING TO US and the British People , like the British Democratic Party , are SICK OF IT !

    • If the figure you state is correct £1.5 Billion is in reality just one days trading in the UK. So not a lot.
      One must realise international finance follows where its at. So us jumping ship is bound to upset them. Still upsetting that particular tribe is worth it every day.

The thins is , that with Britain IMPORTING more from the Superstate Countries than we EXPORT , they would be ‘ cutting their nose off to spite their face ‘ if they were to harsh with us !     • The other countries have said there would be no access to the single market without having freedom of movement allowed by a British PM. I suspect there were a large number of people who voted to leave because they don’t agree with freedom of movement and want there to be stringent conditions placed upon this principle so as to reduce the number of EU migrants coming here. We MUST make the political Establishment in this country realise that the vote was won by the leave side by using this immigration issue. Therefore, we MUST NOT have a Brexit ‘Lite’ and if the cost of having severe restrictions on freedom of movement is either no access at all or less access to the Single Market then SO BE IT!

  3. Can anyone visiting this site name one MP of either party running to show, who has the balls to stop paying that £ 50 million a day from tomorrow and reclaim our fishing territory. Let alone from the 24th of June.
    Even Farage who has now left the stage couldn’t or wouldn’t. What we have is now a constitutional crisis. A Parliament that does not reflect the voice of the people. In fact that’s been the case for the best part of 100 years. Where in a FPTP operates and as little as 29% of those voting can elect a government . If only 70% vote then the actual percentage goes down.
    But folk still do it, and I guess its one reason the elected MP’s despise us so.
    A snap General Election, I believe now with fixed term parliament only a royal decree can do it.
    So Liz what’s the hold up.
    Mind you with Farage gone what hope UKIP has, is fluid to say the least. Back to plan A, vote back in the most spineless bunch of lying cheating back stabbing trough feeders ever and carry on moaning.
    Lets hope I’m wrong, the silent majority have broken their silence .Long may they make a din.

  4. Very fine rhetoric, but utterly removed from reality. The overwhelming majority of the House of Commons opposed Brexit, and is scarcely going to repeal the European Communities Act 1972 without activating Article 50 just so as to please those who voted “Leave”. It might prove to be the devil’s own job to get them to repeal the European Communities Act 1972 at all, though I am pleasantly surprised at how willing the political class seems to be to give effect to the will of the people by carrying the referendum vote (which does not bind Parliament) into effect. Moreover, a disorderly exit from the EU would have serious downside risks for a great many businesses with knock on detriment to the economy, so a tough but sensible negotiation is to be preferred to grand unilateral gestures.

Also, if whoever is the next PM doesn’t signify our intention to leave by pulling the trigger of a article 50 notification by 31ST MARCH 2017 then we can ONLY leave by getting the permission of 14 MEMBER COUNTRIES! From April 1st 2017 (how ironic!) we won’t have the option of using that article 50 OR by repealing the European Communities Act 1972! This is one reason the British political Establishment is stalling for time and also why Angela Merkel says there is no hurry!

    The only Tory candidate that seems to want to pull the trigger quickly is Andrea Leadsom. I really hope Tory MPs, FOR ONCE, put our country first and not their own party and make sure she is one of the last two candidates to put before their party’s membership. Theresa May is a globalist liberal/remainer who ignored one of the few golden rules of politics by castigating her own party at a party conference by calling them the ‘nasty party’. Make no mistake, if she becomes PM she will sell us out! We MUST have a PM prepared to play hardball because there is no doubt that Angela Merkel and company will be doing precisely that!

    • Perhaps, we should have a mass demonstration in central London after the Tories select their new PM calling upon that person to PULL THE TRIGGER quickly! After all, if the pro-EU lot can have one calling for the result to be ignored then those of us IN THE MAJORITY should do so too as we have far more of a REAL DEMOCRATIC MANDATE than they do!

      • I do laugh at those who suggest the referendum result should be overturned because the leave side only won by 3.8% or so. Yes, it wasn’t a landslide but the general opinion of political commentators and the polling companies was that it would be close and I personally thought it would be more like 2% or even fewer percentage points separating the two sides. It was still more than the amount of votes President Obama beat Mitt Romney by and no-one suggests President Obama should have been replaced by Mitt.

    • The Conservative Party (about the only thing they are truely interested in conserving is the wealth of the mega-rich) is still a liberal, globalist capitalist party so people like Michael Heseltine need not fret. They’ve lost on one aspect of globalism but there are others.

          Corbyn has upset the smooth running of this ghastly entity. So in at least one respect we should applaud him. Maybe a bit strong as this guy would negotiate with IS But not the BNP or its later entities.
          What I’m saying therefore, to pinch a bit of Peter Hitchens rhetoric. Britain has been for X amount of years a one party totalitarian state. Voted in time and time again.
          A bit like all religions, whose rules and obligations are in effect chains. But chains loved by their adherents. Simply because they believe they have a choice ,where in fact they do not, and never have.
          Another reason the referendum was / is advisory not binding on parliament.
          Mind you if they try to renege on it will the British public rise against them. That is what they are thinking, not its validity.. Leadson is just smoke and mirrors.

    • One reason Britain will never be like America in regard of its Black residents is , that here they were invited. In America they were dragged there in chains. Had Ha old Abe Lincoln’s dream been realised the black would have been repatriated back to Africa via Liberia. Territory bought by America for that purpose. The Civil war put an end to that . And Lincoln was canonised as the guy who freed the slaves.
      As with most history, its written buy the winners and is always slanted in favour of the current zeitgeist.
      But back to now. What to do. Clinton will use this to her advantage. But in truth only someone like Trump could sort it out, if indeed it can be sorted out. Meanwhile back here we still import thousands of non EU citizens in an insane drive to replicate what’s happening in America.

According to that bible of liberal-left luvvies everywhere, the Guardian newspaper, the first legal challenge to the result has been brought today by a British citizen with the wonderfully traditional British name of Deir Dos Santos! It will be heard before two judges on July 19th. Perhaps, if the foot dragging by the British political Establishment continues for too long we Brexiteers should hold a mass rally in central London to demand the trigger of Article 50 is pulled? I would be willing to go. If the pro-EU lot can have these rallies then so can we!

  9. John, I believe that we must expect the events in America to occur here, as unfortunately we are heading in that direction. We had the worst riots in British history five years ago, because of an armed career criminal being shot by the police…these populations are increasing and the inevitable result will be more crime and disorder.

    There will never be any genuine harmony between their communities and ours…the white liberal’s idea of ”equality” is always siding with the black people and showing indifference and even contempt to the plight of their fellow whites. The fact this is never reciprocated by them to us is something the white liberal has’nt got the brains to evaluate with anything that approaches a balanced sense of judgement.

    As for ”Black Power”, can anyone explain to me exactly what that is ? Is it what they now have in Detroit ? Is it what everyone is running away from in Africa ? Even Kofi Anan referred to independent Africa as ”that cocktail of disasters”.

  10. ( Party Official ) I was incensed to read that a number of Lawyers are claiming the result of our Referendum is not legally binding. ACTUALLY OUR MEMBERSHIP OF THE EUROPEAN UNION SUPERSTATE WAS NOT LEGAL IN BRITISH LAW. There are a number of long standing ( centuries ) British laws that state we can NOT be governed by any FOREIGN POWER !

According to the ”diversity” enthusiasts of the London Standard, ”perhaps it is just as well that the weather is due to turn a little cooler” from their laughable ‘Editorial Comment’.

    Only Nationalism can end this pattern of white flight and the dispossesion of our beleaguered people due to Third World immigration. We are the ONLY PARTY that has the good name and leadership, and the determination to see this fight through…without bowing to political correctness as UKIP have to.
